Nobody understands la migra.<\/p>\n<\/p>\n<p>The INS gets blasted when it unknowingly lets anonymous terrorists into<br \/>\nthe country. The INS gets blasted when it keeps known terrorists out of<br \/>\nthe country. The first example is the WTC nutjobs, the second is Devlin<br \/>\nMcAliskey.<\/p>\n<\/p>\n<p>If, like <a HREF=\"http:\/\/www.ruminatethis.com\/archives\/000946.html\">RuminateThis<\/a><br \/>\nyou were an &#8220;Irish-Catholic kid&#8221; in Brooklyn, you might consider McAliskey<br \/>\na &#8220;heroine&#8221; and a &#8220;world-renowned Irish civil rights leader&#8221; then her<br \/>\n&#8220;deportation&#8221; is indeed a travesty and miscarriage of justice. It then<br \/>\nbecomes easy to imply that she was removed because &#8220;she spoke out against<br \/>\nUS-British plans for a war on Iraq&#8221;.<\/p>\n<\/p>\n<p>If, like myself, you are a professional civil servant denied any avenue<br \/>\nfor political preference in the conduct of your duties, you consider<br \/>\nMcAliskey a <a>HREF=&#8221;http:\/\/www.newsday.com\/news\/nationworld\/nation\/ny-usdev253146306feb25,0,3<br \/>\n228573.story?coll=ny-nationalnews-headlines&#8221;&gt;convicted<br \/>\nfelon and terrorist supporter<\/a>. In which case her expedited removal is<br \/>\na routine enforcement of U.S. immigration laws. I could no more allow her<br \/>\nto enter the United States than I could give Osama bin Laden a free pass.<br \/>\nIt would be negligent, it would be criminal and it would be a violation of<br \/>\nmy oath of service to the U.S. Constitution.<\/p>\n<\/p>\n<p>Because of her multiple convictions (including inciting a riot and<br \/>\nassault) she, unlike her law abiding compatriots, requires a visa to enter<br \/>\nthe United States. Further, that visa must include a waiver from the State<br \/>\nDepartment stating that even though she is a felon she may be admitted to<br \/>\nthe U.S.<\/p>\n<\/p>\n<p>However, because she had entered the United States with the intent to<br \/>\nraise money for a terrorist organization (the Irish Nationalist Liberation<br \/>\nArmy) she violated another section of the U.S. law, for which she would<br \/>\nrequire yet  another waiver.  The State Department, understandably, was<br \/>\nunwilling to grant a waiver for someone who continued to support and<br \/>\nincite terrorist activity. Would you have them granted a waiver to a Hamas<br \/>\nlieutenant? So why for the INLA?<\/p>\n<\/p>\n<p>Sure she was allowed on the plane by the airline: they thought she was<br \/>\njust another Irish traveler would could enter without a visa. If they&#8217;d<br \/>\nknown she was a terrorist they probably wouldn&#8217;t have allowed her to board<br \/>\neven with a visa. &#8230;Kinda like the unfortunate IRA bomber who had to sit<br \/>\nin INS detention because British Airways wouldn&#8217;t let him on a<br \/>\nplane.<\/p>\n<\/p>\n<p>Jeanne Butterfield, executive director of the American Immigration Lawyers<br \/>\nAssociation, said she was appalled by the action. &#8220;It would not surprise<br \/>\nme if they had caught some Arab or Muslim political figure and kept him<br \/>\nout.&#8221; Like Yassir Arafat, who also needs a DOS waiver? &#8220;But to stop people<br \/>\nwho may have been sympathetic to the IRA, it&#8217;s frightening to me.&#8221;<\/p>\n<\/p>\n<p>Yeah, well, catching terrorists is part of my job.
